Terms of Service

1. Eligibility

You must be at least 18 years old to use the Service. By creating an account or using the Service, you represent and warrant that you are 18 years of age or older. The Service is not intended for, and may not be used by, anyone under the age of 18. If we discover that a user is under 18, we will immediately terminate that account and delete associated data.

If you are a parent or guardian and believe your minor child has created an account, please contact us immediately at support@marketbun.com.

2. Account Registration

2.1 Account Creation

To access most features, you must create an account by providing a valid email address, a username, and a password, or by authenticating through a supported third-party provider.

2.2 Accuracy of Information

You agree to provide accurate, current, and complete information and to keep it updated. Providing false information is grounds for immediate account termination.

2.3 Account Security

You are solely responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@marketbun.com if you suspect unauthorized access.

2.4 One Account Per Person

Each person may maintain only one active account. Creating duplicate or fraudulent accounts is prohibited.

3. Description of Service

MarketBun is a discovery platform that allows users to post, browse, and find local yard sales, garage sales, estate sales, and similar community marketplace events. MarketBun connects buyers and sellers but is not a party to any transaction between users. All transactions are arranged solely between users. MarketBun does not process payments, hold funds, guarantee the quality or legality of listed items, or verify user identities.

4. User Content

4.1 License to MarketBun

By submitting content (listings, photos, messages, profile info), you grant MarketBun a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, and display your content solely to operate and improve the Service.

4.2 Content Standards

User content must not be false or misleading, depict illegal items, contain sexually explicit or hateful material, harass or threaten anyone, include others' personal information without consent, or violate any applicable law.

4.3 Content Removal

We reserve the right to remove or disable any User Content at our sole discretion, at any time, without notice.

5. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose;
• Post listings for stolen, counterfeit, hazardous, recalled, or illegal goods;
• Impersonate any person or entity;
• Scrape or systematically extract data without express written permission;
• Interfere with or attempt to gain unauthorized access to the Service;
• Use bots, scripts, or automated tools to interact with the Service;
• Engage in spam, phishing, or unsolicited communications;
• Collect personal information about other users without their consent; or
• Facilitate transactions involving alcohol, tobacco, firearms, drugs, or other regulated goods.

6. Transactions Between Users

6.1 MarketBun Is Not a Party

MarketBun is a platform only. All sales are conducted directly between users, in person, and are entirely the responsibility of the individual buyer and seller.

6.2 No Payment Processing

MarketBun does not process, hold, transfer, or facilitate any payments between users.

You are solely responsible for your personal safety when meeting other users. We strongly encourage meeting in public, well-lit locations.

7. Privacy

Your use of the Service is governed by our Privacy Policy, incorporated into these Terms by reference.

8. Intellectual Property

The Service, including its design, features, software, trademarks, and logos, is owned by or licensed to MarketBun and protected by applicable law. If you submit feedback or ideas, you grant MarketBun a perpetual, royalty-free license to use them without obligation to you.

You agree to indemnify and hold harmless MarketBun, its owner, employees, and agents from any claims, liabilities, damages, and expenses (including attorneys' fees) arising from your use of the Service, your content, your violation of these Terms, or any in-person transaction you arrange through the Service.

12. Termination

You may delete your account at any time through the app. We reserve the right to suspend or terminate your account at any time, with or without cause. Sections 4.1, 6.3, 8, 9, 10, 11, 14, and 15 survive termination.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California. Before filing any legal claim, you agree to first contact us at support@marketbun.com and attempt to resolve the dispute informally for at least 30 days.

If informal resolution fails, disputes shall be resolved by binding individual arbitration administered by the AAA in Stanislaus County, California. You waive the right to a jury trial and class action participation. Either party may bring individual claims in small claims court.

14. Changes to These Terms

We may update these Terms from time to time. We will update the "Last Updated" date and notify you of material changes via the app or email. Continued use after changes take effect constitutes acceptance.
